The Council members are appointed by Royal Decree upon the recommendation of their respective ministers. While the Council is not a political body, it maintains an awareness of administrative relations.

The Council consists of three members, each appointed based on their expertise, for a term of four (4) years. Members may be reappointed for an additional four-year term.

The chairmanship rotates annually among the members. Article 8 of the Consensus Kingdom Act for the Law Enforcement Council outlines the following regarding the appointment of Council members:

1. Members of the Council are appointed based on the expertise required to fulfill the Council's duties.
2. Members must hold the Dutch nationality.
3. Members must not engage in any occupations that could adversely affect the proper execution of their duties, undermine public trust, or compromise their impartiality and independence.


Formula for taking the oath or making an affirmation by the members of the Council:
"I swear/affirm that I will be faithful to the King and obey the statutory regulations. I swear/affirm that I have not given or promised any gift or favor, directly or indirectly, under any name or pretext whatsoever. I swear/affirm that I have never accepted and will not accept, either directly or indirectly, under whatever name, any gift from any person whom I know or suspect to be involved in any inspection requiring my official duties. So help me God! This I declare and promise."
