Law Enforcement Council's role

The Law Enforcement Council is an independent regulatory body, established by the Kingdom Act on October 10, 2010. The Council is responsible for the general inspection of the organizations of the judicial chain with the exception of the Joint Court of Justice in Curaçao, Sint Maarten, Bonaire, Sint Eustatius and Saba.

What the Law Enforcement Council does:


Conduct Inspections
Based on the Kingdom Act the Council conducts inspections at organizations within the judicial chain in Curaçao, Sint Maarten, Bonaire, Sint Eustatius, and Saba. These organizations are:
— Police, police training, and the Public Prosecutor's Office.
— Agencies and institutions where prison sentences and measures for the restriction of or deprivation of liberty are executed, or where probation and after-care service and victim care are provided to adults and juveniles.
— Other organizations designated by national ordinance or law, which fall under the Minister's responsibility as outlined in the Kingdom Act and are part of the judicial chain.

Quality Control
The Council inspects the effectiveness, the quality of the performance of duties and the management of the mentioned organizations.

Inspects Cooperation
The Council also inspects the quality and effectiveness of judicial cooperation between the countries within the Kingdom of the Netherlands.

Publish Reports
The Council publishes reports with findings and recommendations based on the inspections carried out.


What the Law Enforcement Council does not do:


Inspect the Joint Court of Justice
The Council does not inspect the Joint Court of Justice.

Handle Individual Cases
The Council does not handle individual cases or legal disputes.

Initiate Criminal Proceedings
The Council does not have the authority to initiate or carry out criminal proceedings on behalf of others.

Make or Change Laws
The Council does not have the authority to make or change laws.

Perform Operational Tasks
The Council does not perform operational tasks in maintaining public order or other law enforcement activities.
