This inspection report examines the prosecution policy of the Public Prosecution Service (OM) in Curaçao. The Minister has the authority to issue instructions, but has not issued formal guidelines, while the OM sets priorities via the annual plan. Prosecution decisions are made on the basis of feasibility and expediency, but the criteria for these decisions are not public. The need for improved administration, transparency and timely handling of cases is pointed out. The Council makes recommendations to establish the prosecution policy, publish guidelines and improve administrative processes.
