This inspection report examines the exchange of police and judicial data within the Kingdom, with an emphasis on compliance with international standards and internal procedures. It is found that the exchange of police data between the countries involved, although legally required, is in practice seen as optional, and that there are no formal guidelines or legal basis for the arrangement between Curaçao, Sint Maarten and the Netherlands. In addition, guidelines for the exchange of data are lacking in various places and insufficient account is taken of retention periods and data security. The report concludes that the current systems of data processing and security do not meet international standards, although some authorities have taken adequate measures. Various recommendations are made to strengthen legislation and internal procedures, including the drafting of guidelines and improving cooperation between investigative services within the Kingdom.
